Terms of Service

1. About These Terms
These Terms of Service (“Terms”) govern your access to and use of the HALO website, platform, and services (together, the “Service”). The Service is operated by Halo Clinic Pty Ltd (ACN 696 922 120) (“HALO”, “we”, “us”, “our”).
By creating an account, purchasing a test, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. If you are using the Service on behalf of another person, you confirm that you are authorised to do so.
2. Eligibility
To use the Service, you must:
- be at least 18 years of age;
- be a resident of Australia and physically located in Australia when you use the Service;
- have the legal capacity to enter into a binding agreement; and
- provide accurate, current, and complete information about yourself and your health.
We may decline to provide, or may withdraw, the Service to any person at our discretion, including where we consider it is not clinically appropriate or not permitted by law.
3. Our Service
HALO provides a consumer health service centred on blood testing and the presentation of your results. This includes facilitating pathology collection through third-party providers, arranging for your results to be reviewed by AHPRA-registered healthcare practitioners, and presenting your biomarker results against standard reference ranges and HALO’s functional (“optimal”) ranges through your account.
The Service is intended to give you information to help you understand and optimise your health. It is a wellness and information service. It is not an emergency service, a diagnostic service, or a replacement for the ongoing care of your general practitioner or other treating practitioners.
4. Not Medical Advice; No Emergencies
The information provided through the Service, including your results and any optimal-range indicators, is general in nature and is not a diagnosis. It does not constitute medical advice and is not a substitute for consultation with a qualified healthcare practitioner who can consider your full medical history and circumstances. You should not disregard, avoid, or delay obtaining medical advice because of information you have received through the Service.
The Service is not for medical emergencies. If you are experiencing a medical emergency, or you are concerned about your immediate health or safety, call 000 (triple zero) or go to your nearest emergency department.
5. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use. We are not liable for any loss arising from unauthorised use of your account where you have not kept your credentials secure.
6. Health Information You Provide
To provide the Service safely, we rely on the information you give us. You agree to provide accurate and complete information about your health, medications, and history, and to keep it up to date. Providing inaccurate or incomplete information may affect the safety and usefulness of the Service, and in some cases may mean we cannot provide it to you.
7. Testing, Collection, and Results
Blood sample collection is carried out by independent pathology collection providers. Their services are subject to their own terms and availability, and access to collection may depend on your location.
We aim to make your results available in a timely manner, but turnaround times are estimates only and are not guaranteed. They depend on factors outside our control, including laboratory processing and the clinical review process. Results are indicative and should be interpreted in the context of your overall health. Where a result suggests you should seek further care, we encourage you to speak with your general practitioner or another appropriate practitioner.
8. Fees, Payment, and Refunds
The fees for the Service are displayed at the time of purchase in Australian dollars and, unless stated otherwise, are inclusive of GST where applicable. You authorise us (and our payment providers) to charge the payment method you provide for the amounts shown.
Because testing involves the engagement of third-party providers and clinical review, refunds are handled on a case-by-case basis and may not be available once a service has been performed. Nothing in this section limits any rights you have under the Australian Consumer Law (see section 12). If you believe you are entitled to a refund, please contact us using the details in section 16.
9. Acceptable Use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- use the Service on behalf of another person without their authority, or provide information that is not your own without a lawful basis;
- attempt to gain unauthorised access to, interfere with, or disrupt the Service or its underlying systems; or
- copy, resell, or commercially exploit any part of the Service except as expressly permitted.
10. Intellectual Property
The Service, including its content, design, software, and the HALO name and branding, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable licence to use the Service for your own personal, non-commercial use in accordance with these Terms. Your own personal information and results remain yours, and are handled in accordance with our Privacy Policy.
11. Third-Party Services and Links
The Service may rely on, or link to, third-party services such as pathology providers, payment processors, and other health providers. We are not responsible for the content, products, or practices of third parties, and your use of their services may be subject to their own terms and privacy policies.
12. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law where to do so would be unlawful.
To the extent we are permitted to limit our liability for a failure to comply with a consumer guarantee (other than a guarantee that by law cannot be limited), our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
13. Disclaimers and Limitation of Liability
Except for the guarantees and rights referred to in section 12, and to the maximum extent permitted by law, the Service is provided “as is” and we make no warranties, express or implied, about the Service or the information provided through it, including as to its accuracy, completeness, or fitness for a particular purpose.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Service. Nothing in these Terms limits our liability where it cannot be limited by law, including liability for death or personal injury caused by our negligence.
14. Privacy
We handle your personal and sensitive health information in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use, disclose, and protect your information.
15. Suspension, Termination, and Changes
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or where we reasonably consider it necessary to protect the Service or other users. We may also update these Terms from time to time; the latest version will always be available on our website, and your continued use of the Service after an update takes effect constitutes your acceptance of the revised Terms.
16. Governing Law and Contact
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
